BayTSP, a San Franscisco company which
specializes in tracking down copyrighted material on the internet, is touting a new system called FirstSource which it
claims can identify the original uploader of a copyrighted file, send them a scary warning, and log their personal
information for legal action. The TechNewsWorld article
mentions eDonkey and BitTorrent specifically, but of course the actual technique at work is shrouded in mystery. The
system is available only to the highest bidders, and they're mum on the actual technique at work, but my dumb guess is
that it involves continually polling the P2P networks for the names of soon-to-be-pirated files.
At least BayTSP has to good sense not to claim they have a magic bullet to kill piracy.

1. What happens if a second person starts downloading the file within seconds of it's upload and then finishes the download before this system polls the network? Will they be able to tell the difference between the two people?
